It's one of the first things we check with any owner considering vacation rental in Málaga or the Costa del Sol, because it affects both the legality of the activity and the owner's peace of mind.
What a Vivienda con Fines Turísticos is
It's the legal category that regulates, in Andalusia, the rental of whole properties for short tourist stays in exchange for payment. It differs from long-term rental (governed by the Spanish Urban Leases Act) precisely because of its vacation, by-the-season nature.
What the regulation generally requires
Broadly speaking, these properties must meet habitability conditions, have direct outside ventilation in the living areas, include certain equipment (climate control, first-aid kit, tourist information for the guest), and be registered with the Andalusian Tourism Registry before starting to operate. Some municipalities and areas — especially in multi-unit residential buildings — may add further restrictions depending on what the homeowners' association decides.
Why it's not worth renting without it
Renting without the corresponding registration exposes the owner to fines, and also makes it harder to operate safely on serious booking platforms and channels, which increasingly ask for proof that a listing is legal. Beyond the legal side, having the property properly regularised gives peace of mind if any issue comes up with guests.
